TERMS OF SERVICE

These Terms of Service govern your access to and use of the DiamondArt website and your purchase and use of digital products available through our store.
By accessing our website, placing an order or downloading a digital product, you agree to these Terms of Service, our Privacy Policy and our Return and Refund Policy.
1. Digital products
DiamondArt sells downloadable digital artwork and related digital content.
All products sold through this store are digital products unless explicitly stated otherwise. No physical artwork, print, frame or other physical item will be shipped.
Product mockups, frames, furniture and interior settings shown in photographs are for presentation purposes only and are not included in the purchase.
2. Product information
We make reasonable efforts to ensure that product descriptions, previews, included file formats, dimensions and other information are accurate.
Colours may appear differently depending on the customer’s screen, printer, ink, paper, colour profile and print settings. Minor colour differences do not automatically indicate that the digital product is defective.
Customers are responsible for reviewing the product description and confirming that the included file types, dimensions and print ratios are suitable for their intended personal use before purchasing.
3. Orders and contract formation
By submitting an order, you make an offer to purchase the selected digital product under these Terms.
A binding contract is formed when:
- your payment has been successfully authorised; and
- we confirm the order or provide access to the digital product.
We reserve the right to reject or cancel an order where reasonably necessary, including in cases of payment failure, suspected fraud, pricing error, technical error or unauthorised use of the store.
Where an order is cancelled by us after payment, the amount paid will be refunded.
4. Prices, taxes and payment
Prices are displayed in the currency indicated on the website.
Applicable taxes are calculated and charged in accordance with the customer’s location and applicable law.
Payments are processed through Shopify Payments or another payment provider shown during checkout. We do not normally receive or store complete payment card details.
The customer is responsible for providing accurate billing and contact information.
5. Digital delivery
Digital products are normally made available after successful payment through:
- a download link displayed after checkout;
- an email containing a download link; or
- another digital delivery method described during purchase.
Delivery is considered completed when access to the digital files or a functioning download link has been provided.
Customers are responsible for:
- entering a valid email address;
- downloading the files within any stated access period;
- storing a personal backup copy;
- ensuring that their device can open ZIP and JPG/ PNG files;
- maintaining the confidentiality of their download links.

6. Immediate supply and right of withdrawal
Where permitted by applicable law, by expressly requesting immediate access to the digital content, you agree that delivery may begin before the expiry of the statutory withdrawal period.
You acknowledge that, once access to or downloading of the digital content begins following your express consent, you may lose your statutory right of withdrawal.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.
7. Personal-use licence
Unless a separate commercial licence is expressly purchased, all digital products are licensed for personal use only.
Subject to these Terms, you receive a limited, non-exclusive, non-transferable and revocable licence to download and print the purchased artwork for your own personal use.
You may:
- print the artwork for your personal residence;
- print the artwork more than once for personal use;
- display the printed artwork in your personal space;
- give an individual printed copy as a personal, non-commercial gift.
Ownership and copyright in the artwork and digital files remain with DiamondArt or the relevant rights holder.
8. Prohibited uses
You may not:
- sell, resell or redistribute the digital files;
- share the files or download links with another person;
- upload the files to file-sharing websites, marketplaces or public platforms;
- sell physical prints or reproductions of the artwork;
- use the artwork on products intended for sale;
- use the artwork as part of a logo, trademark or brand identity;
- modify the files and present or sell them as original work;
- use the files for commercial premises, client projects or business purposes without an appropriate commercial licence;
- use automated systems to copy, extract or reproduce the content;
- claim authorship or ownership of the artwork.
Unauthorised use may result in termination of the licence and further action to protect our intellectual property rights.
9. Intellectual property
All website content, product images, artwork, graphics, branding, text and downloadable files are protected by applicable copyright, trademark and intellectual property laws.
Purchasing a digital product does not transfer copyright or ownership of the artwork to the customer.
Only the limited usage rights expressly described in these Terms or in a separately purchased licence are granted.
10. Refunds and defective digital content
Due to the digital nature and immediate availability of the products, purchases are generally non-refundable once the digital content has been made available, subject to applicable consumer law.
This does not affect your mandatory rights where the digital content:
- cannot be accessed;
- is corrupted or technically defective;
- is materially different from its description;
- is not supplied as agreed;
- otherwise fails to conform to the contract.
Where required by law, we will provide an appropriate remedy, which may include restored access, corrected or replacement files, a proportionate price reduction or a refund.

11. Customer responsibilities
You agree:
- to provide accurate information during checkout;
- not to use the store or products unlawfully;
- not to interfere with the website’s operation or security;
- not to attempt to gain unauthorised access to files or systems;
- to comply with the licence conditions attached to the purchased product.
You are responsible for ensuring that your chosen printing provider, paper, dimensions and settings are suitable for the intended result.
12. Third-party services
Our store is hosted by Shopify and may use third-party payment, digital delivery, analytics, marketing and technical service providers.
Your use of certain third-party services may also be governed by their respective terms and privacy policies.
We are not responsible for a third-party service where liability legally belongs to that independent provider, but this does not affect any rights you have against us under mandatory consumer law.
13. Website availability
We may update, suspend or modify parts of the website where reasonably necessary for maintenance, security, legal compliance or business operations.
We do not guarantee that the website will always be uninterrupted or error-free. However, this does not affect our obligation to provide digital products already purchased or any mandatory consumer rights.
14. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect or consequential losses that were not reasonably foreseeable at the time the contract was formed.
We are not responsible for differences caused solely by:
- the customer’s screen settings;
- third-party printing services;
- printer calibration;
- paper or ink selection;
- incorrect file ratio or print-size selection;
- modification of files by the customer or another party.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct or mandatory consumer rights.
15. Changes to these Terms
We may update these Terms from time to time to reflect changes in our services, business practices or legal obligations.
The Terms applicable to an order are generally those published when the order is placed, unless a change is required by mandatory law or is more favourable to the customer.
The latest version will be published on this page with an updated revision date.
16. Governing law and consumer rights
These Terms are governed by the laws of the Republic of Lithuania.
If you are a consumer residing in another EEA country, this choice of law does not deprive you of mandatory consumer protections available under the laws of your country of residence.

Consumers may also have the right to contact the competent consumer protection authority or use applicable alternative dispute-resolution procedures.
